GENERAL TERMS AND CONDITIONS WELLNESS B&B DE LUXE FINNEN

 

1. Definitions

In these General Terms and Conditions, the following terms shall be understood, both in singular and plural form:

B&B: Wellness B&B De Luxe Finnen, established at Boerestreek 44 in (9211 TV) Kortehemmen and registered with the Chamber of Commerce under number: 93591012, email address: info@deluxefinnen.nl and telephone number: 0512 – 212 438.

Agreement: the rental agreement concluded between B&B (as lessor) and you (as lessee) concerning the accommodation (the rented property) which is of short duration by nature pursuant to Article 7:232 paragraph 2 of the Dutch Civil Code.

House Rules: the terms of use of the B&B.

 

2. General

2.1 Only these General Terms and Conditions apply to the Agreement between you and B&B.

2.2 If the provisions of the Agreement deviate from these General Terms and Conditions, those provisions shall prevail.

2.3 Other agreements are only valid if these have been agreed upon in writing.

2.4 Upon request, you will receive a free copy of these General Terms and Conditions.

2.5 If a provision or part thereof of these General Terms and Conditions proves to be invalid, this does not affect the binding nature of all other provisions of the General Terms and Conditions. The remaining part of that specific provision shall also remain in force.

2.6 B&B may amend these General Terms and Conditions. Amendments shall also apply to Agreements already concluded if B&B has notified you of this amendment.

 

3. The Accommodation

3.1 You are responsible for your own actions and omissions, and the actions and omissions of anyone to whom you grant access to the accommodation. You must properly secure the accommodation to prevent damage and theft.

3.2 You ensure that the accommodation is used carefully and exclusively for recreational purposes. Therefore, no commercial activities may take place in the accommodation.

3.3 You are obligated to comply with the agreements made, including the Agreement, these General Terms and Conditions, and the House Rules. You must also follow the instructions that B&B provides for the use of the accommodation.

3.4 It is prohibited to allow others to use the accommodation and no more persons may stay than has been agreed upon.

3.5 You are obligated to leave the accommodation clean, properly cleaned, free of damage, and with all keys, keycards, etc. returned. In case of loss of a key, € 100 will be charged.

3.6 You may only bring pets if written permission has been given by B&B.

3.7 It is possible that not all additional facilities – including the hot tub and/or swimming pool – can be used during your stay. B&B will make efforts to enable the use of these facilities. However, you have no right to reimbursement of the accommodation costs in that case.

3.8 If you breach the agreements made – as set out in the Agreement, these General Terms and Conditions, or the House Rules – a fine of € 250 per breach may be imposed by B&B. In addition, any costs for cleaning, repairs, and damage resulting from the inability to rent the accommodation may also be charged. B&B is entitled in that case to suspend its obligations or terminate the Agreement without prior notice of default being required.

 

4. The Reservation and Payment of Accommodation Costs

4.1 All reservations of the B&B take place on the basis of availability via the B&B website, by telephone, or by email. Reservations are not possible for persons under eighteen years of age.

4.2 The Agreement is only concluded once the reservation has been confirmed in writing by B&B.

4.3 You must indicate at the time of reservation how many persons will stay at the B&B.

4.4 Rates may be adjusted by B&B if you wish to change the date of your stay.

4.5 The accommodation costs include:

  • VAT;
  • tourist tax;
  • breakfast, unless otherwise agreed;
  • bed linen;
  • towels, bathrobes, and kitchen linens;
  • final cleaning.

4.6 The accommodation costs must be paid prior to the stay, unless you have made other arrangements with B&B. If you do not pay on time, you will automatically be in default.

4.7 All other payments must be made within the payment period, and in any case no later than fourteen (14) days after the invoice date, unless otherwise agreed in writing. If you do not pay on time, you will (also) automatically be in default.

4.8 If you stay longer than four (4) nights, B&B may request a deposit of 50% of the accommodation costs.

4.9 You owe a security deposit of € 300 and must pay this before arrival. You will receive the security deposit back if you have used and left the accommodation in accordance with the Agreement, the General Terms and Conditions, and the House Rules. You will receive the security deposit back within fourteen calendar days after your stay if everything has been found in order by B&B to the bank account from which you made the payment.

4.10 It is not permitted to transfer the reservation to third parties unless B&B agrees to this.

4.11 If you leave early, regardless of the reason, you have no right to reimbursement of the accommodation costs or any proportional part thereof.

 

5. Cancellation conditions if you cancel the booking

5.1 Cancellation is free of charge up to thirty days before arrival via the email address with which the reservation was confirmed by B&B. In case of cancellation within thirty days before arrival or in case of no-show, you are liable for the full accommodation costs.

5.2 If you have made a deposit, B&B will refund it in full if you have cancelled thirty (30) days before arrival. The deposit will be refunded as soon as possible, but no later than fourteen (14) calendar days.

 

6. Liability

6.1 If damage occurs or is likely to occur to, on or at the accommodation and/or the facilities and/or the property of B&B, you must inform B&B immediately. You must also immediately take appropriate measures to prevent or limit further damage to the accommodation or the facilities.

6.2 B&B is not liable for loss, theft, damage or injury during the stay, unless there is intent or gross negligence on the part of B&B. B&B is also not liable for any loss of your enjoyment of the accommodation and/or of the guests and/or for damage to your/their property that arises from visible or invisible defects in the accommodation and/or the facilities. However, this does not apply if the damage is the result of a defect in the accommodation and/or the facilities that already existed at the time of conclusion of the Agreement and B&B knew or should have known this.

6.3 You are presumed to have received the accommodation, the facilities and the inventory of the accommodation in good condition. Any damage(s) and/or missing inventory must be reported to B&B immediately. You are yourself responsible for damage to the accommodation, the facilities, the inventory of the accommodation and the surrounding area that occurs during your stay. All damage, with the exception of fire damage, is presumed to have arisen therefrom.

6.4 B&B is at all times – at its own discretion – entitled to deny you and/or other guests access to the accommodation and/or the facilities if you do not comply with the agreements made – including the Agreement, the General Terms and Conditions and the House Rules – or in case of improper conduct. In that case, you have no right to a refund of the accommodation costs.

6.5 B&B is not liable for indirect damage, including (but not limited to) consequential damage, lost savings, business interruption and/or delay damage. The liability of B&B is in all cases – except in case of intent and/or deliberate recklessness – limited to compensation of direct damage only in connection with a culpable breach of the agreements made and to a maximum of the amount paid out by its insurer minus the deductible and – insofar as its insurer does not pay out for whatever reason – to the accommodation costs.

 

7. Force Majeure

7.1 B&B is not obliged to perform the agreements made in case of force majeure. Force majeure is understood to include, in any case but not exclusively, the destruction or (temporary) unusability of the accommodation.

7.2 Temporary failure or limited availability of the wellness facilities (such as swimming pool, sauna or jacuzzi) due to technical faults also falls under force majeure and does not entitle you to a refund of your accommodation costs or a discount.

7.3 In case of force majeure, each party has the right to terminate the Agreement in writing. In that case, B&B retains the right to full compensation for the services rendered up to that point and the costs incurred, regardless of the remaining agreed length of stay.

8. Promotions

8.1 You consent to receiving an invitation for a review or promotional offer after your stay.

 

9. Complaints

9.1 We strive to make your stay as pleasant as possible. Despite our best efforts, it is possible that you may have a complaint or remark. In order to resolve this properly, we ask you to inform us of this as soon as possible on site, via email or by telephone contact.

 

10. Final Provisions

10.1 These General Terms and Conditions, the Agreement and the House Rules are governed exclusively by Dutch law. Unless in conflict with mandatory law, all disputes and claims arising from or in connection with the Agreement shall be submitted to the competent court of the District Court North Netherlands, location Leeuwarden. You have the right to choose, within one month after B&B has invoked this provision, for settlement of the dispute by the civil court competent according to law.

10.2 If any part of these General Terms and Conditions or the Agreement(s) between you and B&B is void or voidable, this does not affect the validity of the other provisions. The void, voidable or otherwise unenforceable part is (deemed to be) replaced by a valid and enforceable provision that aligns as closely as possible with the purpose and intent of the replaced provision.

10.3 The House Rules form an integral part of the Agreement and these General Terms and Conditions.

 

THE HOUSE RULES

Within the Bed & Breakfast and on the premises, the following house rules apply:

Accommodation

1. On the day of arrival, you may use your accommodation from 15:00 hours onwards, unless otherwise agreed.
2. On the day of departure, the accommodation must be vacated by 11:00 hours, unless otherwise agreed.
3. Breakfast is served by mutual agreement between 07:00 and 11:00 hours.

Facilities

  1. Smoking is not permitted within the accommodation.
  2. Open fire is prohibited inside and outside the accommodation, with the exception of the use of the BBQ outside the accommodation.
  3. Noise disturbance must be avoided between 22:00 and 07:00 hours.
  4. Visitors are not permitted to stay overnight without the permission of the Bed & Breakfast and without paying an additional fee.
  5. Parking is available on the premises, but is entirely at your own risk.
  6. Waste must be separated and disposed of in the designated containers.
  7. The use of the swimming pool and hot tub is entirely at your own risk.
  8. When using the swimming pool and hot tub, you are required to keep noise levels low and not to cause any noise disturbance.
  9. Children under the age of sixteen may only use the swimming pool and hot tub under the supervision of an adult.
  10. You are required to immediately report any contamination or dangerous situation in or around the swimming pool or hot tub, including glass in the water, to the Bed & Breakfast.
  11. If pets are permitted, the following applies: (1.)Pets must always be kept on a leash on the premises. (2.)Pets are not permitted on furniture or in beds. (3.)Pets must be exercised outside the accommodation and surrounding premises. (4.)Any damage or additional cleaning costs caused by pets will be charged to you in full. (5.)Disturbance caused by pets, such as barking or soiling, may result in immediate termination of your stay without refund of accommodation costs.
  12. You must comply with all (safety) instructions from the Bed & Breakfast at all times.
  13. The Bed & Breakfast may determine at its own discretion whether your behaviour and/or the behaviour of your guests is unacceptable. In such cases, the Bed & Breakfast may take appropriate measures, including the immediate prohibition of the use of the accommodation by you and/or your guests.
